The defence lawyer for a former Far
North police officer accused of rape says his client does not deny having sex
with the victim - but says it was consensual. The accused, who has name
suppression, is on trial at Auckland District Court facing eight historical
charges including four of rape in relation to an incident in 1988. The Crown says the victim was
handcuffed and raped despite her repeated protests. But in his opening address, Gary
Gotlieb for the defence said the sex was instigated and promoted by the
complainant. He says after a formal complaint
was made in 1988, a full investigation by Northland detectives found
insufficient evidence to lay charges. Mr Gotlieb says the decision was
supported by the police legal section, numerous superior officers and the
Minister of Police.
