Cross exam continues in rape trial

The defence for a former police officer accused of rape says the woman pointed the finger at him so she did not have to tell her boyfriend she cheated on him.

The woman is under cross examination at the man's trial in Auckland, where he stands accused of rape, sexual violation and assault over an incident in 1988.

Defence lawyer Gary Gotlieb says when the woman's boyfriend asked her if she had been raped she agreed, so that she could get herself out of the situation.

Gotlieb says the woman passed the police station and the hospital on her way home after the incident, but chose not to seek help. He says two years prior the woman seduced her friend's husband, and referred to him as a naughty little boy.

That is the same phrase the defence claims she used while having consensual sex with the accused.

The defence also claims the woman admitted being turned on by the accused and said she may have led him on.

Gotlieb says when the woman spoke to police the day after the alleged rape in 1988, she said she said did not try to fight his advances and called herself a flirt who may have led him on.  He says she told the policeman she was quite turned on by what happened but still felt the accused used his authority as a police officer against her.

He says the woman was aware she was not making an official complaint, but the woman has completely denied the claims.
