Indecency charges

A former St John of God brother has been committed for trial on three counts of inducing an indecent act, after a short depositions hearing in the Christchurch District Court yesterday.

Bernard Kevin McGrath faces three charges of inducing a boy under 16 to do an indecent act, allegedly committed between February and June 1977.

Prosecutor Andrew McRae said the complainant was a student at Marylands School, Christchurch, under the care of the defendant. Police allege that on three separate occasions indecencies occurred against the complainant.

Counsel Nigel Hampton, QC, asked for all evidence in a victim statement before the court to be suppressed. He said objection would be taken to the admissibility of the entire evidence, on the grounds of cross- contamination.

McGrath was remanded on bail by Justice of the Peace Caroline Kellaway to appear at a pre-trial conference in late October, subject to the conditions he not associate with children under 16, or any former student of Marylands School.
