Lawyers sum up in pack rape trial

The last of the evidence has been given in the pack rape trial in the High Court at Wellington and lawyers have begun summing up their cases.

Four men deny abducting and raping a 20 year old woman in Mount Maunganui in 1989.

The crown prosecutor told the jury the defence claim that the complainant consented to sex is simply untenable and unbelievable.

Summing up the Crown's case lawyer Mark Zarifeh told the jury the evidence given by the accused was carefully crafted nonsense. Zarifeh said the defence claim that the complainant consented to have group sex with virtual strangers was simply unbelievable.

Summing up his client's case on Friday defence lawyer Paul Mabey QC told the trial the complainant is lying and regrets taking part in group sex.

Mabey told the jury that the complainant, now a mother of three, has a clear motivation for making false allegations.

On Thursday the jury heard the last of the defence evidence, with one of the final witnesses being the fourth man to have sex with the complainant.

The 40-year-old told the jury that when he arrived at the group sex encounter the complainant was not distressed and seemed to be willing and enthusiastic. He said initially she was surprised to see him but said he might as well stay.
