The Court of Appeal is
being asked to consider the implication of fresh evidence as four men appeal
rape convictions. Warren Hales, Peter
McNamara and two men whose names remain suppressed were found guilty of a
pack rape at Mount Maunganui in 1989. Defence lawyers are
submitting what they claim is new evidence of a friendly meeting between one
of the four men and the victim, five days after the rape. Defence lawyer Greg
King claims new evidence shows Hales attended a Crowded House concert five
days after the attack. He says the victim
approached Hales and rubbed her hands on him. Mr King says that behaviour is
radically inconsistent with claims of gang rape. He believes the trial
outcome could have been different if the jury had access to that evidence. Hales also has new
legal representation, accusing his lawyer during last July's trial of
incompetence. |
