Rape accused not guilty

A Patea farmer fought to contain tears of relief when a New Plymouth jury found him not guilty on five sexual charges yesterday.

Darryl Walter Hutton (45) stood in the public gallery embracing supporters after his release.

Hutton had denied two charges of rape, two of unlawful sexual connection and a further charge of indecent assault in the three-day trial.

The complainant had alleged the crimes took place between 2001 and 2005.

The court had been told by a doctor who examined the 15-year-old complainant that no evidence supporting or refuting a sexual assault had been found.

Samples taken from the victim and examined by a scientist at the ESR also found no traces of semen.
