Appeal against extradition decision

An appeal has been filed against an Australian court decision that two Catholic clergymen would not have to return to New Zealand to face child sex charges.

Rodger Moloney and Raymond Garchow, both of the St John of God Order, are accused of abusing boys at the Marylands residential school in Christchurch during the 1970s and 80s.

Last month an Australian judge overturned an extradition order on the grounds that the men wouldn't get a fair trial in New Zealand because of differences in the legal systems relating to historical cases.

Following approval from New Zealand's Solicitor-General and the Director of Prosecutions in Sydney, an appeal against that decision has been lodged.

It is not known how long it will take for the appeal to be heard.
