19-20 March 2007; Deposition Hearing

After a two day deposition hearing, the league player has been ordered to stand trial.

The 37 year old complainant was heavily intoxicated when she met the accused at The Whiskey Bar in Ponsonby. She had been drinking wine all night and had taken cocaine. They later ended up in a car on College Hill near Victoria Park.

The prosecution alleges that the complainant was then raped and sexually violated. The woman claimed that he had ejaculated inside her, but there were no traces of semen found in the samples taken from her.

The accused denies being rough or aggressive, and denies having sex with her, but the woman performed oral sex on him.. He drove the woman back to a taxi rank, and paid for a taxi but refused to drive her home. She was not happy, and started to sulk, but the accused said he never expected her to cry rape..

15 August 2006 - Name suppression continued until trial

Name suppression is continued until trial. In a hearing the judge agreed with defence submissions that publicising the man's name would jeopardise a significant number of third parties.

13 August 2006 - Accused will fight charges

The accused will fight the charges against him. “He would defend the sexual abuse charges and was determined to defend his name and reputation.”

13 August 2006 - Lawyer furious with police
The lawyer for the league player, Gary Gotlieb, is furious police refused to back his bid for his client's name to remain secret. In the last court appearance he reacted angrily when Crown prosecutor Deb Bell said name suppression was opposed, turning to two detectives in the public gallery and accusing them of going back on an earlier promise not to oppose suppression.

"I'm just blown away. Police give you an undertaking ... it's certainly the last time I'm going to co-operate with the police,"  He also said bail conditions sought by the Crown, including a curfew and strict reporting clauses, were a
"nonsense". His client had not appeared before the courts before.

11 August 2006 - Reaction to sex charges

NZ Rugby League Chief executive, Selwyn Pearson, was shell-shocked. “I don’t believe it”

Former Kiwis coach Graham Lowe said his first reaction to the charges was sadness. "I just think that it highlights that society, in whatever form it is, can bring out the best and the worst in us."

Crown prosecutor Debra Bell said that no drugging-related charges would be laid, despite early reports of the complainant being drugged

10 August 2006 - Three charges of sexual violation, including rape

The rugby league player faces three sexual violation charges, including rape and sodomy. The alleged offences occurred on June 15. In a court hearing, the man was supported by several family members. The man has interim name suppression, and his lawyer Gary Gotlieb says there are compelling reasons for it to be continued.
